A consumer forum in Delhi has asked Nathu’s Sweets to pay around Rs 1 lakh to a south Delhi resident for supplying inferior quality ‘ladoos’ which were unfit for human consumption.

The New Delhi District Consumer Disputes Redressal Forum, presided by C K Chaturvedi, has asked the firm to pay Rs 95,920 to Monika K Sapra. “We hold OP (firm) guilty of supplying inferior quality ‘ladoos’ which were rancid,” the forum said.

“We direct OP to return Rs 25,920 (cost of ladoos), Rs 50,000 for deficiency, embarrassment and loss of reputation faced before invitees and hurting her sentiments and pay Rs 20,000 as litigation expenses,” it said.

Sapra said she had ordered 80 packets of ‘ladoos’ for a birthday party on September 22, 2012. However, the item was foul-smelling and had a bitter taste. Sapra said she approached the firm but did not get any response. She then independently submitted a packet of packed “ladoos” to a laboratory which reported the food was not fit for consumption.

She said she had served a legal notice to the firm demanding a refund, compensation and legal expenses but it was rejected. Thereafter, she approached the consumer forum which noted that the firm had avoided mediation to settle the matter and had rather filed a fresh report of Food Laboratory, Delhi Government, of a sample of fresh “ladoos”.

“The OP has tried to take unfair advantage by haved a fresh batch tested rather than agreeing to the poor quality of ladoos supplied,” it said.

The forum added that the firm had indulged in unfair practices by not accepting the FSL report obtained by Sapra and also by avoiding mediation in the matter, thereby forcing the complainant to approach the consumer forum.
