HC Summons Chief Secy, HUDA Boss Over Groundwater Misuse – Times of India – 06-Jan-2015

Punjab and Haryana high court on Monday directed Haryana chief secretary and chief administrator of Haryana Urban Development Authority (HUDA) to appear before it for their failure to control illegal extraction of groundwater in Gurgaon by colonies and builders.

Both officers have been asked to file a report about the steps taken by state authorities to control the misuse of groundwater. They will have to appear in person before the high court on January 9.

A division bench headed by justice S K Mittal passed the orders while hearing a petition filed by Mukesh Sharma, a resident of Silokhra village of Gurgaon district.

During the hearing of the case on Monday, Gurgaon deputy commissioner TL Satyapraksh informed the court that administration had constituted 22 teams to check illegal use of groundwater. He also informed that as many as 910 borewells had been sealed by those teams after carrying several inspections.

It was further stated that around 157 borewells have been found to be installed by construction companies who have been given NOC by the town and country planning department and recommendations were made to town and country planning to cancel their licences.

However, on receiving undertaking from them, the builders were allowed to carry on the construction activities and are not using the underground water for construction activities.

The DC further stated that city magistrate Gurgaon is carrying regular inspection of the area, especially Sectors 68 to 80 to check illegal extraction of underground water for construction activities.

The petitioner, however, argued before the court that Haryana government is favoring the builders and deliberately giving them a clean chit despite misuse of underground water in Gurgaon.

Hearing this, the bench directed state chief secretary and HUDA chief administrator to appear before the court and explain the steps taken by the state authorities to check the misuse of underground water in the state.

In this case, petitioner has sought directions to take action against the defaulting projects violating the norms laid down by environment protection act and various notifications relating to illegal extraction of ground water for construction projects in Gurgaon.

Petitioner had also conducted a sting operation showing the misuse of underground water in Gurgaon by builders and had produced the CD containing video recording before the HC.
